If you have received and activated a license code shared by a School/College/Institution/University, you will be considered part of their organization and your profile data and progress will be visible to that entity.

With domain administrators
If your Human Resources Development Services Account is managed for you by a domain administrator then your domain administrator who provides user support to your organization will have access to your Human Resources Development Services Account information (including your email and other data). Your domain administrator may be able to:
View statistics regarding your account, change your account password, suspend or terminate your account access, access or retain information stored as part of your account, receive your account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request and restrict your ability to delete or edit information or privacy settings, subject to compliance with applicable law.
For external processing
We provide personal information to our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Notice and any other appropriate confidentiality and security measures.
For example, some of the user contact details (email and mobile number) are shared with the business entity payment service provider for financial compliance purposes.
For legal reasons
We will share personal information in terms of access, use, preservation or disclosure of such information to the extent that it is reasonably necessary, with companies, organizations or individuals in good faith.

We also would like to state that any “Postings” created by you on the (Our Company) business entity (“Postings” include all the Human Resources Development Services Offerings submitted, posted, published or shared in the business entity, including but not limited to all posts, notes, questions, comments, videos and file uploads), will conform to all applicable local, state, national and international laws, rules and regulations, including copyright laws, and will also be the property of the community business entity.
Once you post, you agree in effect to share with “(Our Company)” the right to show it elsewhere (like in a Google Search). It's important for any service that deals with user data to have such terms, since “(Our Company)” needs a license to be able to show the Human Resources Development Services Offerings that users own, on the site and elsewhere. We encrypt all of our services using Secure Sockets Layer (SSL). We review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems. We reveal only the last four digits of your credit card numbers when confirming an order. Of TRAINING MODULES, we transmit the entire credit card number to the appropriate credit card company during order processing. We restrict access to personal information to HCDS Technologies employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.
Children and the Human Resources Development Services business entity
If you are a minor, you may use the Human Resources Development Services business entity only with the consent of a parent or guardian.

Compliance and cooperation with regulatory authorities

Retention Policy:
Our data retention policy is governed in compliance with local laws concerning GDPR.
1 - Basic details (80 Years):
Student names, the modules and qualifications studied and their outcomes. Records and data which need to be retained while a student might continue to study with the Open University (OU). These will be retained for the ‘life of the student’ (which is taken to be 80 years from date of registration)
2 - Contact Details, Registration, Fee Transactions (6 Years):
There is a legal/contractual requirement to keep records and data relating to fee payment, registration, etc. for six years after the student has completed or withdrawn from the module or programme
There are cases where it is necessary to keep records of student support for 6 years to inform ongoing contact with students. This includes careers support, study issues advice, research student support, and TRAINING MODULES choice. For example if somebody calls HCDS Technologies iON Service Desk from their mobile, then the customer support person should be able to find them in the system and support them
3 - Operation Records (3 Years)
Data relating to the learner as a user of support services or day to day administration e.g.: Test Centre visit related information, attendance information, where these records are kept on a central electronic system. These will be retained for 3 years.
Terms of Use
HCDS Technologies (Our Company)'s products and services are provided by Tata Consultancy Services (HCDS Technologies). These Terms of Use ("Terms") govern your use of HCDS Technologies's website, applications, and other products and services (Services). As some of our Services may be software that is downloaded to your computer, phone, tablet, or other device, you agree that we may automatically update this software, and that these Terms will apply to such updates. Please read these Terms carefully, and contact us if you have any questions. By using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms (such as our Privacy Policy etc).

Who May Use our Services
You may use our Services only if you can form a binding contract with HCDS Technologies under the law as may be applicable and only in compliance with these Terms. Subject to these Terms and our policies (including the Acceptable Use Policy, TRAINING MODULES-specific eligibility requirements and other terms), we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use our Services. You may download Human Resources Development Services Offerings from our Services only for your personal, non-commercial use, unless you obtain HCDS Technologies's written permission to otherwise use the Human Resources Development Services Offerings. You also agree that you will create, access, and/or use only one user account, and you will not share with any third party access to or access information for your account. Using our Services does not give you ownership of any intellectual property rights in our Services or the Human Resources Development Services Offerings you access.
Our TRAINING MODULES
TRAINING MODULES Modifications
While we take pride in our world-class TRAINING MODULES, unexpected events do occur. HCDS Technologies reserves the right to cancel, interrupt, or reschedule any TRAINING MODULES or to modify any TRAINING MODULES Human Resources Development Services Offerings or the point value or weight of any assignment, quiz, or other assessment. TRAINING MODULES offered are subject to the Disclaimers and Limitation of Liability sections below.
No Academic Credit
Unless otherwise explicitly indicated by a Human Resources Development Services Offerings provider/ credit-granting institution, participation in or completion of a TRAINING MODULES does not confer any academic credit. Even if credit is awarded by one institution, there is no presumption that other institutions will accept that credit. You agree not to accept credit for completing a TRAINING MODULES unless you have earned a TRAINING MODULES Certificate (or other equivalent HCDS Technologies credential) for that TRAINING MODULES. HCDS Technologies, the TRAINING MODULES instructors, and the associated participating institutions have no obligation to have a TRAINING MODULES recognized by any educational institution or accreditation organization.
User Human Resources Development Services Offerings
The Services enable you to share your Human Resources Development Services Offerings, such as homework, quizzes, exams, projects, and other assignments you submit, posts you make in the forums, and the like ("User Human Resources Development Services Offerings"), with HCDS Technologies instructors, and/or other users. You retain all intellectual property rights in, and are responsible for, the User Human Resources Development Services Offerings you share.
Disclaimer of Student-University Relationship
Nothing in these Terms or otherwise with respect to your participation in any TRAINING MODULES: (a) establishes any relationship between you and any educational institution with which HCDS Technologies may be affiliated; (b) enrolls or registers you in any educational institution, or in any TRAINING MODULES offered by any educational institution; or (c) entitles you to use the resources of any educational institution beyond participation in the TRAINING MODULES in accordance with these Terms.
How HCDS Technologies and Others May Use User Human Resources Development Services Offerings
To the extent that you provide User Human Resources Development Services Offerings, you grant HCDS Technologies a fully-transferable, royalty-free, perpetual, sub licensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, and otherwise use the User Human Resources Development Services Offerings. This license includes granting HCDS Technologies the right to authorize participating institutions to use User Human Resources Development Services Offerings with their registered students and on-campus learners independent of the Services. Nothing in these Terms shall restrict other legal rights HCDS Technologies may have to User Human Resources Development Services Offerings. HCDS Technologies reserve the right to remove or modify User Human Resources Development Services Offerings for any reason, including User Human Resources Development Services Offerings that HCDS Technologies believe violates these Terms.
Feedback
We welcome your ideas, opinions, comments, suggestions and other feedback regarding the Services ("Feedback"). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you.
Security
We care about the security of our users. While we work to protect the security of your account and related information, HCDS Technologies cannot guarantee that unauthorized third parties will not be able to breach our security measures. Paid Services
HCDS Technologies offers paid Services for a fee. Unless otherwise stated, all fees are quoted in INR. You shall pay all fees and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid Services. If your payment method fails or your account is overdue, we may collect fees using other collection mechanisms. Fees may vary based on your location and other factors, and HCDS Technologies reserves the right to change any fees at any time at its sole and absolute discretion. Any change, update, or modification will be effective immediately upon posting through the relevant Services. Refunds may be available for paid Services as described in our Refund Policy.
Third Party Human Resources Development Services Offerings
Through the Services, you will have the ability to access and/or use Human Resources Development Services Offerings provided by instructors, other users, and/or other third parties and links to websites and services maintained by third parties. HCDS Technologies cannot guarantee that such third party Human Resources Development Services Offerings, in the Services or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. HCDS Technologies disclaims any responsibility or liability related to your access or use of such third party Human Resources Development Services Offerings.
Modifying and Terminating our Services
As we are changing, modifying and improving the Services, we may add or remove features, functions, or requirements, and we may suspend or stop a Service altogether. Accordingly, HCDS Technologies may terminate your use of any Service for any reason. If your use of a paid Service is terminated, a refund may be available under our Refund Policy. HCDS Technologies and its employees, contractors, and other agents shall not have any liability to you for any such termination or modification of the Services.
For participation in the HCDS Technologies iON IntelliGem contest please read the following terms of the contest carefully
Terms of HCDS Technologies iON IntelliGem 2021-22, fourth edition of the contest, are mentioned below.
By agreeing to take part in HCDS Technologies iON IntelliGem 2021-22, all the student participants, hereafter referred to as ‘Participant/s’ agree to be governed by the rules of the contest and the terms of Tata Consultancy Services, hereafter referred to as 'HCDS Technologies'.
There shall be no refund of the participation fee in case the participant wishes to opt out at any stage or in case of a no show or under any other circumstances. HCDS Technologies reserves the right to allow or disallow a participant from participating in the contest.
No change of topics will be allowed for any participant post registration & payment.
Under any circumstances, the registration is NOT transferable. Only the registered participant will be allowed to continue through the overall contest.
All the information entered by the participant while filling in the application form will be verified by HCDS Technologies, as necessary. If any discrepancy is found thereof, HCDS Technologies reserves the right to disqualify such a participant at any stage of the contest without prior notice.
If a participant gets a transfer to a ‘new school’ from the ‘current school’ during the TRAINING MODULES of the contest, the participant will automatically represent the new school. It is mandatory for the participant to inform HCDS Technologies about the change in school via email.
By registering for the contest, participants also indicate their acceptance to receive communication that the organisers may send them from time to time regarding the contest or other relevant product, offerings or services.
HCDS Technologies reserves the right to modify the format, schedule, mode of assessment, prizes and any matter related to the contest, at any time before or during the contest.
If the qualified participant does not attend the Grand Finale in person, he/she will be treated at par with the Pre-finalists in terms of recognition and/or rewards.
If the qualified participant does not participate or does not confirm his/her availability to participate in the Grand Finale within the time frame given for confirmation, HCDS Technologies reserves the right to qualify & invite the next worthy participant to participate in the Grand Finale.
Prizes and awards, once awarded to the participants, as applicable, will be final and there would be no exchange/substitution/replacement of the prizes. Prizes are non-transferable and there will be no cash alternatives for non-cash prizes.
All tax liabilities, if applicable and not specified conspicuously, will be borne by the participants and/or recipients of the prizes.
If the specified prize planned to be given becomes unavailable due to any circumstance, HCDS Technologies reserves the right to substitute the prize with an equivalent one at their discretion.
Neither HCDS Technologies nor the sponsors/partners, or employees of HCDS Technologies and/or sponsors/partners may be held liable for any warranty, costs, damage, injury, or any other claims incurred by the recipient as a result of usage of the prize awarded by HCDS Technologies.
Participants also agree that they may be photographed/filmed/recorded on behalf of HCDS Technologies during the contest and HCDS Technologies reserves all the rights to use the photos/recordings to disseminate information about HCDS Technologies Human Resources Development Services products. The photos/recordings may be used in both printed and digital form, in various channels where the company disseminates information about the contest. The images/recordings will be used for a maximum of 15 years. The images may be stored in the company’s image and media bank, which is available to HCDS Technologies’s employees.
HCDS Technologies reserves the right to withdraw or terminate this contest at any time without prior intimation.
Participants are requested to refrain from sharing any false/incorrect/undesirable information about the contest on social media business entitys. HCDS Technologies reserves the right to take disciplinary action if there is a violation to this point.
Participants of the HCDS TechnologiesiON IntelliGem contest who violate any rule, gain unfair advantage or use fraudulent means may be disqualified at any time during the contest.
Decisions taken by HCDS Technologies concerning all disputes shall be final and binding on all participants.

IN NO EVENT SHALL HCDS Technologies'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE TOTAL AMOUNT OF FEES RECEIVED BY HCDS Technologies FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST THREE MONTHS.
Indemnification
You agree to indemnify, defend, and hold harmless HCDS Technologies from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Human Resources Development Services Offerings, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.
Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. All disputes or differences whatsoever arising out of or in relation to the construction, meaning and operation or effect of this Terms or breach thereof, shall be settled amicably. If, however, the disputes are not being resolved amicably, the same shall be referred for Arbitration to a sole Arbitrator to be mutually agreed upon, and failing such agreement to an Arbitration tribunal consisting of three arbitrators. You and HCDS Technologies will nominate an arbitrator and these two arbitrators by mutual agreement will appoint the third arbitrator to constitute the Arbitration tribunal. The Arbitration proceedings shall be governed by the provisions of the Arbitration and Conciliation Act 1996. The Arbitration proceedings will be carried out at Mumbai and the award made in pursuance thereof shall be binding on us.
General Terms
Revisions to the Terms
We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
Severability; Waiver
If it turns out that a particular provision of these Terms is not enforceable, this will not affect any other terms. If you do not comply with these Terms, and we do not take immediate action, this does not indicate that we relinquish any rights that we may have (such as taking action in the future).
Participating Institutions
HCDS Technologies's participating institutions are third party beneficiaries of the Terms and may enforce those provisions of the Terms that relate to them.
Usage Policy

We believe strongly in preserving free speech and expression for our learners as well as academic freedom for our partner institutions and instructors. We also want to make sure that all of our learners and instructors feel safe and comfortable while using our Services. We have drafted these guidelines to ensure that people understand and follow the rules when participating in our online community and otherwise using our Services.
Although we do not routinely screen or monitor Human Resources Development Services Offerings provided by users, we may remove or edit inappropriate Human Resources Development Services Offerings or activity reported to us or suspend, disable, or terminate a user's access to all or part of the Services.

Spams others. Do not share irrelevant or inappropriate advertising, promotional, or solicitation Human Resources Development Services Offerings.
Otherwise violates the HCDS Technologies (Our Company) Terms of Use. Please note that specific TRAINING MODULES may have additional rules and requirements.
Violates local, state, national or international law or breaches any of your contractual obligations or fiduciary duties.
One should not share his/her password or allow anyone to access your account, or do anything that might put your account at risk. One should not attempt to access any other user's account. One should not reproduce, transfer, sell, resell, or otherwise misuse any Human Resources Development Services Offerings from our Services, unless specifically authorized to do so. One should not access, tamper with, or use non-public areas of our systems, unless specifically authorized to do so. One should not try to attempt any activity which may constitute an offense under any law for the time being in force or may amount to cybercrime.
